Distance Sales Agreement

2. Subject

This agreement sets out the rights and obligations of the parties, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation, for the sale and delivery of the Spitfire Pro software license the Buyer ordered electronically on spitfire.tr.

3. Product

  • Nature: an electronically signed license key, valid for the plan's term, that lifts the free edition's limits in the Spitfire load testing software (concurrent virtual users, requests per second, run length, runners and locations per run, number of users).
  • The software runs on the Buyer's own servers (Docker, Kubernetes or Windows; amd64 and arm64). The Seller provides no hosting, operation or data storage; the key is verified offline and needs no connection to the Seller.
  • Payment is one-time; the license does not renew and nothing is charged again.

4. Price and payment

Payment is made by credit or debit card on the secure payment page of PayTR, a licensed payment institution. Card details do not reach the Seller and are not stored by the Seller. Any instalment charge applied by the bank is between the Buyer and the bank. The invoice is issued electronically after payment with the details the Buyer gave.

5. Delivery

The license key is e-mailed to the address the Buyer gave within the same business day after the payment is confirmed (orders placed on weekends and public holidays: the next business day). Delivery takes place when the e-mail with the key is sent; there is no physical delivery. The license term starts on the day the key is issued. When it ends, 14 days of grace follow; then the software keeps running within the free edition's limits and none of the Buyer's data is deleted.

6. Right of withdrawal

The product is intangible content delivered electronically; delivery is complete when the e-mail with the license key is sent. Under Article 15(1)(ğ) of the Distance Contracts Regulation the right of withdrawal does not apply to a delivered license. The Buyer confirmed this separately when ordering.

Nevertheless, if the Buyer tells [email protected] that they withdraw from the order before the license key is sent, the full amount is refunded to the card used within 14 days of that notice.

7. Defective performance

If the license key does not work, or the product does not match the features stated in this agreement and the preliminary information form, the Buyer reports it to [email protected] and the Seller provides a working key. If the problem cannot be fixed, the amount paid is refunded. The Buyer's other rights under Law No. 6502 are reserved. The Buyer can try the software with the free edition before buying.

8. License terms

The license is granted to the Buyer, and where the Buyer is an organisation to that organisation, for use in one Spitfire installation. The license key may not be transferred, sold, rented or published. Circumventing the software's protection and license mechanisms is prohibited.

9. Personal data

10. Disputes

Where the Buyer is a consumer, consumer arbitration committees at the Buyer's place of residence or where the transaction was made are competent within the monetary limits announced yearly by the Ministry of Trade, and consumer courts above them; before suing in a consumer court, applying to a mediator is mandatory under Article 73/A of Law No. 6502. Where the Buyer is not a consumer, the courts and enforcement offices of Ankara are competent.

11. Entry into force

This agreement is concluded when the Buyer gives electronic approval while ordering. The agreement and the preliminary information form are sent to the Buyer's e-mail address with the order details.
